Froehlich v. Ohio Department of Mental Health, 2003-Ohio-1277 was reversed by Froehlich v. Ohio Department of Mental Health, 2005-Ohio-7026 on a procedural ground. The appellate court found under Ohio Revised Code 2305.11 the statute of limitations for malicious prosecution was 1 year from when the cause of action accrues. Nurse Froehlich had until April 4, 2001, to file her malicious prosecution complaint against the Ohio Department of Health. Her complaint was filed on August 8, 2001, and therefore was barred by the statute of limitations. Based on this procedural history, the legal reasoning of the original decision remains good law, because the grounds for the appellate court's reversal were solely procedural and did not in fact overrule the legal reasoning and basis for the original decision.
