CDC: State Preemption Rates Unchanged in Tobacco Efforts

No progress in reducing state preemption of local advertising, youth access restrictions

THURSDAY, Aug. 25 (HealthDay News) -- The number of U.S. states that preempt local advertising restrictions and youth access restrictions to tobacco products appears to have remained unchanged, according to a report in the August 26 issue of the Centers for Disease Control and Prevention (CDC)'s Morbidity and Mortality Weekly Report.

The CDC expanded previous analysis to track changes in state laws that preempt local advertising and youth access restrictions and to examine policy changes from December 31, 2000 to December 31, 2010 to measure progress toward achieving Healthy People 2020 objectives. A Healthy People 2020 objective aims to eliminate state laws that preempt stronger local tobacco control laws.

The report revealed that no progress was made during the period in reducing the number of states that preempt local advertising restrictions and youth access restrictions, despite substantial progress achieved during the past decade in reducing the number of states that preempt local smoking restrictions. According to the report, the number of states that preempt local smoking restrictions decreased from 18 at the end of 2000 to 12 at the end of 2010. However, the number of states preempting local advertising restrictions remained the same at 18 during that period and the number of states preempting local youth access restrictions increased from 21 to 22 during the time period.

"Increased progress in removing state preemption provisions will be needed to achieve the relevant Healthy People 2020 objective," the authors write.
