Abstract

As scientific research discovers more health benefits from foods, legal risks have increased that such "functional foods" might be regulated as drugs. Recent changes in the law allow "health claims" to be made for foods that meet certain criteria; however, the standards for such claims are the subject of ongoing controversy among scientists, lawyers, and the Food and Drug Administration. The trend appears to be in favor of more health claims, possibly with qualifying or disclaimer language.
