In a recent article published by JONA's Healthcare, Law, Ethics, and Regulation titled A Hospital's Malicious Criminal Prosecution of a Registered Nurse, the author failed to mention that the case upon which she based her conclusions was reversed and remanded by the Tenth District Court of Appeals for the State of Ohio. You may wish to direct your readers to Patricia Froelich v. State of Ohio Department of Mental Health, 2006 Ohio 2466, 2006 Ohio LEXIS 1541 (Ohio, May 24, 2006). Furthermore, this matter has been appealed to the Supreme Court of Ohio and is awaiting a decision.
